company has either gone into liquidation already or shutting donw now...
Same story here. Took them to small claims last year and got paid 1st 2 installments. Took them to small claims this January 21st and now have judgement against them by default (yesterday). They are real bad eggs. I'll let you know how it turns out.
Bought a Vodafone contract from them in October 2006 on the free line rental by redemption scheme. I sent in all the details required within the correct time window but they completely ignored me. After several attempts at contact I finally took them to the small claims court and they paid up the first 2 of 3 installments. I submitted the details for the 3rd installment late last year and they again ignored me; I subsequently took out another small claim on 21st January 2008. They ignored this claim and I was awarded judgement by default yesterday. It is vital that a complete record of contact is maintained and that all letters are sent via "signed for" post as they will deny receipt otherwise. These are real bad eggs and need to be put out of business for good.
I am also in the same position with Phones2direct Sent letter with all supporting documents requesting first part of cashback on the 16th of October with a proof of delivery. The letter was delivered to them on the 19th of October before 12.50. I have tried phoning them costing me a fortune, but no reply. Have sent many emails only receive back automated response requesting I search the FAQ's. I am now going to take this to the online court as you suggest. I hope I will be lucky!!
In November 2007, I made an online claim against P2UD and have just received a cheque for £409 from the company.
It cost £35 to make an online claim, and the process was straightforward - the call centre staff were friendly and helpful when I rang with a few questions. I claimed interest on the money owed (£360) as well as the online claim fee.
I hope my experience encourages others to pursue the legal option.
I like the idea of meeting them in person and also would like to issue a county court claim against them, but I don't know much about the procedures and also not sure whether it is appropriate to meet them directly. Please advice me and let me know more about the plan of action.
My other query is whether this company is still working/trading at the same address. I made an attempt to make an order at their website and got redirected to another dealer's site.
Those looking or within a cooling off period - suggest you AVOID this company at all cost. Those victims like me - vote on http://petitions.pm.gov.uk/MobilesCashback/
I purchased 12 month free contract. I was careful to ensure that I complied with their T & C in minute detail. After 55 days of submiting by recorded delivery, I threatend to bring legal action, and eventualy got the first cheque but not the full amount. After another angry email, got the balance. Same with the second cash back. However, the third claim is proving very difficult. Despite submitting the claim on 18 Sept, and despite various emails to every single dept in that company, I have had no joy. I am now actually issuing county court claim. This company needs to be closed down.period.
Phones2udirect have lost many court cases because their T&C are unlawfulsince they are in breach of The Unfair Terms In Consumer Contracts Regulations 1999
It has all the information you may want on Phones2udirect, from how to submit your cashback claim, to how to make a court claim. It also contains clarifications on some of the 'grey areas of their T&C'.
This company may be in finacial trouble. That could be the reason as to why they don't response to your complaints about cashback. Either go to small claims court or try claiming your money from your house/contents insurance instead. Rogue companies like phones2udirect should not be allow to trade. Unfortunately, Watchdog, etc don't seem to be able to help. I can't understand why they are still offering cashback on mobiles in their website when they don't have the intention to pay up.
I'm a reporter for 'Mobile' (www.mobiletoday.co.uk), a mobile phone industry weekly magazine.
I've been investigating cashback (in particular Dialamobile's collapse) and am currently looking into the number of times phones2udirect has been taken to the small claims court. To do this, I really need any case reference numbers you have.
Please can you email any to me, at george.bevir@nhmedia.co.uk or call me on 020 7440 3872
Or, any info relating to failed cashback claims.
thanks,
George
I have 12 months cash back rental contract with this company and sent necessary documents on time i.e. after 3 months and 6 months which I have the receipt but never received any email abt this. and was supposed to receive my cash back after every 3 months and I am still waiting after almost 8 months, trying to call them, once I was successful to get hold of them on phone and customer service was not very helpful in replying abt cash back and suggested me to contact sales department. I have sent email to sales department several times which I still saved them, but always got the automatic reply. I am worried about my money. Is there anyone here who wants to take appropriate action? I will look forward to get any reponse to get any help or suggestion?
Thanks.
Has anyone any success with claims directly with them or do I have to go through small claims court? I have registered my complaint with Consumer Direct and to BBC Watchdog. Don't think much about Consumer Direct as they can't do much on your behalf. I am still waiting for a reply from BBC Watchdog.
I took out a 12 months mobile phone contract with phone2udirect with promise of cashback in 3 instalments. I posted my first claim on the 23rd August by Special Delivery and have evidence that they have received my claim on the 24th August. It is now 53 days (Terms and Conditions state cashback within 45 days) still no response of cashback from the Company other than that they will investigate the matter. I have tried to phone them on their 0870 several times but no they don't pick up calls.
I presume if all fails, I will have to go to small claims court and maybe 2 other times.
Just let everyone know that I already ring http://www.consumerdirect.gov.uk/ to report my case and they filed my complaint. I will send letters to my MP next week and hopefully he will pass this to his colleague. And, I wonder if anybody supports if I sign a E-Petitions at downing street, http://petitions.pm.gov.uk/new to protest the behaviour of this company. I just heard on BBC people signed petitions against the advertised broadband speed http://news.bbc.co.uk/1/hi/technology/7003113.stm
my 6th month claim was rejected because they said
1. i claim too early. I purchased the phone on 1st Feb and claimed in Aug. I sent the July's bill
2. i sent the 'network copy'. I have an online account with vodaphone. They don't send me paper bill because I can see them online. But I ring them and ask Vodaphone to send me one anyway. the one they sent has 'copy bill' on it. Despite this, it is still from Vodaphone. I did not make any copy from anywhere.
I cant believe how so many people have been ripped off by this company, i thought it was just me having to deal with this rubbish!
I have just received a letter from them to say my first claim (6 months) has been rejected, apparently for 2 reasons.
That i sent in my claim too early & sent an invoice copy.
I now realise the invoice was a couple weeks too early but assumed 6 months from January was July! mistakes can easily happen & one should NOT be penillised for it.
Even if the invoice was received a couple weeks too early it's better to be early than late at least they had all the nesscessary documents, my point is this.....if they had notified me a.s.a.p after receiving my claim i would of had time to rectify the discrepancy, but they waited 45 days before telling me, in which time it was too late & the 21 days time scale had gone by.
Vodafone gave me an orignal invoice & i sent them that, NOT a copy!
This is a load of rubbish & im VERY angry, it appears they are looking for any excuse to reject claims & rip people off.
I have sent them a few e-mails & had a reply to say they are standing by their T&C & therefore not paying out.
I am NOT one to accept such nonsense & will be pursuing this matter, even if it means taking them to court. Im not going to loose £400.
After seeing many of you experiencing the same problem as me im even more determined to sort this out, im not sure how to go about pursuing this through the court & would appreciate any help / advice available. (caz2108@yahoo.com)
Im thinking of writing to Watchdog aswell, anyone had any success with them?

looking for someone who want to sue Phones2udirect.com together.
I have submitted my claim through small
claims court. The hearing will take place
in the Northampton county court. The date
is not decided yet, if anyone want to
take the action with me together, please
contact me engp1827@hotmail.com.
I am in the process of suing Phones2udirect. I am
in London. If anyone can provide me a copy of the
old T&C's on or after 12/12/2006, I will be very grateful. Please contact me at engp1827@hotmail.com.
My big fault is I did not print the original T&C's
when I entered the contract in 12/12/2006 in which
they have not explained the 6th month bill in their context. However, I sill try to sue them with the risk of losing another 50£ court fee.
Phones2udirect is a rubbish. They refused my
first cashback even if they received my 6th
bill and 7th bill. I have issued them a warning.
I will definitely sue them in the small claims
court if they do not response.
By the way, small claims court only costs 20 to 30
pounds, why some of your guys still complain it
is expensive? I noticed some of you guys
suggested protest in the front of his office. I doubt this is more effective and efficient than suing them.
having been rejected for cahback from phones2u etc the trading standards office has siad that the company is under investigation by ofcom for its trading practices. if anyone feels that they would like to persue a court action against this company then it would be better to put forward a joint action between all of us instead of using the small claims court. it may be a lot cheaper as well. anyone want to go for this ?
i complied with all the requirements to recieve the first 6 months cashback. then got the letter (36 days later)telling me i had not supplied one bill(which was incorrect) and therefore would not qualify for the cashback. complained by email, got an instant reply telling me i was well outside the claims period and therefore not getting the first claim and not being considered for the second or third either. Spoke to trading standards who said that 'I know the Citizens Advice Bureau have made a super complaint to the Office of Fair Trading due to the number of complaints they have received from people in a similar situation to you as there are many companies who do not refund cash back and OFCOM are also making enquiries into cash back offers.' so what can we do ? can we claim through our house or personal insurance ? as i paid the bills with a creidt card can i claim from them - can we issue a writ collectively against the company for damages ?
any ideas ? regards
mike
2. Phones2udirect has been sourcing business for your network provider
3. While sourcing this business, enticed by high commission promises by service provider, they adopt this unfair trade practices
4. Make complain to Telecom arbitrator about network provider complaining how network provider is promoting unethical practices within community by turning blind eye against Phones2udirect- this is free and can be done online.

Is a good start and I will be putting in a court claim but thinking I could save time doing it in person. Anyone interested?
I am going to court against this Company in Jan and will let you know the result. I've found a great support here.
One more piece of information if you guys don't know. BBC is reporting on mobile cash-back rip-off.
